II. Scope of Application
These General Terms and Conditions of Sale (hereinafter, “GTC”) govern the purchase of watches and accessories of the Invicta brand (hereinafter, the “Products”) through the Website invictawatch.eu , made available by INVICTA RETAIL SPAIN, SL exclusively for end consumers, excluding purchases made by companies or professionals.
By placing an order, the Customer declares to be over 18 years of age, to have the legal capacity to contract and to accept that the contract can only be formalized in Spanish.
Sales are only available within mainland Spain and the Balearic Islands (no shipments to the Canary Islands, Ceuta or Melilla).
III. Acceptance of the CGV
The purchase of Products implies the express and unreserved acceptance of:

IV. Product Information
INVICTA RETAIL SPAIN, SL displays the essential characteristics of each Product (photographs, materials, diameter, movement, water resistance, functions and other technical specifications), in as much detail as possible.
However, the images are for illustrative purposes only and there may be slight variations in color or texture due to screen settings.
In case of error in the published information, it will be corrected immediately and the Customer will be informed if said error affects an order in progress.
Error correction before purchase:
Before finalizing the purchase process, the Customer may review and modify the order details (Product, quantity, shipping address, payment method).
V. Product Availability
All orders are subject to availability.
The contract will be considered perfected only after confirmation of the order by INVICTA RETAIL SPAIN, SL
If a product is unavailable after purchase, the customer will be informed and may choose between:
- Full refund (within a maximum of 14 calendar days), or
- Replacement with an alternative product of equal value (subject to Customer acceptance)
VI. Prices
Prices are expressed in euros (€), include applicable VAT and, unless otherwise stated, the Free standard shipping to mainland Spain and the Balearic Islands.
During promotional or discount periods, the lowest price of the last 30 days will be displayed, in accordance with the (EU) “Omnibus” Directive.
Before finalizing the order, all additional costs, if any, will be displayed.
INVICTA RETAIL SPAIN, SL may modify prices at any time, but the applicable price will be the one in effect at the time of order confirmation.
In case of a clear error in the price, the Customer will be informed so that they can decide whether to continue with the purchase at the corrected price or cancel the order.
VII. Purchasing Process
- Select the product and add it to your cart.
- Please review the order information.
- Register or purchase as a guest, providing your shipping details.
- Select the available payment method (credit card, debit card, Klarna, shop pay, google pay, etc).
- Before finalizing, the Client may correct any errors and must accept these Terms and Conditions.
- After making the payment, the Customer will receive an email confirmation with the order summary.
VIII. Reservation of Title
Ownership of the Products is transferred to the Customer only after the total amount has been paid in full (products, taxes and additional expenses if any).
IX. Delivery Time and Conditions
- Usual turnaround time: 1 to 5 business days.
- Maximum legal period: 30 calendar days (contract establishes a maximum of 7 days except for force majeure).
- Carriers: SEUR, Correos Express or others depending on the area.
Deliveries are made only on business days . The customer will receive the tracking link in the order confirmation email.
If the carrier cannot make the delivery due to the absence of the Customer, a second attempt will be made or it will be sent to a collection point.
If delivery is not possible due to reasons attributable to the Customer (incorrect address, repeated absences), the reshipping costs may be passed on.
Unjustified delay:
If the delivery exceeds the agreed deadline without justified cause, the Customer may request the termination of the contract and a full refund.
Risk transmission:
The risk of loss or damage is transferred to the Customer only when they physically receive the Product.
X. Billing and Payment
Accepted payment methods:
- Bank card (Visa, Mastercard, Maestro, AMEX, etc).
- Google Pay, Apple Pay, Shop Pay, etc.

Payment is processed through a secure gateway with SSL encryption and anti-fraud systems (including 3D Secure).
The invoice is issued in electronic format and will be sent to the Customer by email.
XI. Product Warranty
All Invicta products are covered by:
1. 3-year legal guarantee
In accordance with Royal Legislative Decree 1/2007 and Directive (EU) 2019/771, against manufacturing defects or lack of conformity.
2. Manufacturer's warranty
Invicta offers a 1 year warranty for the watch battery.
3. Warranty Exclusions
The warranty does not cover:
- Damage resulting from blows, falls or misuse.
- Damage from moisture when the indicated water resistance is not respected.
- Tampering, opening or repairs by unauthorized third parties.
- Normal wear and tear of straps, crystals or batteries (except for manufacturing defects).
- Cosmetic damage from normal use.
4. Availability of spare parts
Invicta guarantees the availability of essential spare parts for a minimum period of 5 years from the date of purchase (EU regulations).
5. Warranty Procedure
To make use of the warranty, the Customer must:
- Submit the request using the contact form available on the website
- Follow the instructions, and the Customer Service team will contact you within approximately 24 hours to continue the process.

INVICTA RETAIL SPAIN, SL will assume the shipping costs if the defect is covered by the warranty.
XII. Right of Withdrawal
The Customer has 14 calendar days from receipt of the Product to withdraw from the contract without needing to justify their decision.
INVICTA RETAIL SPAIN, SL will assume the return costs in mainland Spain and the Balearic Islands.
Exceptions to the right of withdrawal (Art. 103 Consumer Law):
- Customized products.
- Products handled beyond what is necessary to verify their nature, characteristics and functioning.
- Used watches with clear signs of wear or manipulation of the strap.
Return conditions:
Products must be returned in perfect condition, without signs of use and in the original packaging, documentation and accessories.
Refund period:
14 calendar days from when we receive the Product or a reliable proof of its shipment.

XIII. Security
The Website uses SSL security protocols, encrypted communications, and anti-fraud systems to protect Customer information.
When payment is made by bank card, the information is processed in accordance with the PCI-DSS transaction security standard.
XIV. Disclaimer
INVICTA RETAIL SPAIN, SL will not be responsible for delays or incidents arising from force majeure or causes beyond its reasonable control (strikes, weather incidents, technical failures, etc.).
It will also not assume responsibility for technical interruptions of the Website, misuse of the Product by the Customer, or content of external sites linked from the Website.
The maximum liability to the Customer is limited to the amount of the order.

XVII. Applicable Law and Jurisdiction
These General Terms and Conditions shall be governed by and construed in accordance with current Spanish legislation, including Royal Legislative Decree 1/2007 (General Law for Consumers and Users).
In case of conflict, the competent court will be that of the Client's domicile.
