In compliance with the provisions of Law 34/2002, of July 11, on Information Society Services and Electronic Commerce, we inform you that the owner of this website is INVICTA RETAIL SPAIN, S.L., a Spanish company with tax identification number B10695336, registered office at Paseo de Gracia nº 118, Principal, 08008 Barcelona, email: info@invictawatch.eu, registered in the Mercantile Register of Barcelona (hereinafter, "INVICTA RETAIL SPAIN, S.L." and/or "We").

II. Scope

These General Terms and Conditions of Sale (hereinafter, “GTC”) regulate the purchase of Invicta brand watches and accessories (hereinafter, “Products”) through the Online Store of the website www.invictawatch.eu (hereinafter, “Website”), which INVICTA RETAIL SPAIN, S.L. makes available exclusively to final consumers (hereinafter, “Client/s” or “You”).

Products are intended for adults. By placing an order, you declare that you are of legal age and have the legal capacity to enter into a contract.

Sales territory: the Online Store operates throughout Spain.

III. Acceptance of the GTC

The purchase of Products through this Website implies the express, full, and unreserved acceptance of:

  • These General Conditions of Sale.
  • The Legal Notice.
  • The Privacy and Cookie Policy.

Each order will be governed by the GCS in force at the time it is placed.

IV. Product Information

Invicta Spain displays Product information on the Website as accurately as possible (photographs, technical specifications, prices, etc.). However, there may be slight variations from the actual product due to color or screen resolution adjustments.

In case of any error or omission in the Product information, INVICTA RETAIL SPAIN, S.L. will correct it as soon as possible.

V. Product Availability

  • Stock is updated regularly, but all orders are subject to availability.
  • If a Product is not available when preparing your order, you will be informed by email and the amount will be refunded within a maximum of 14 calendar days.
  • You may, if you wish, accept an alternative product of similar characteristics and value.

VI. Pricing

  • All prices are expressed in euros (€) and include VAT.
  • Standard shipping costs to mainland Spain and the Balearic Islands are free (other shipping methods may incur additional costs).
  • INVICTA RETAIL SPAIN, S.L. reserves the right to modify prices at any time, with the price valid at the time of order confirmation being applied.
  • In the event of a manifest error in the price, it will be corrected immediately and you will be notified.

VII. Procurement Process

  1. Select the Products and add them to the cart.
  2. Go to “Shopping Cart” to review your order details.
  3. Register as a Customer and enter your personal and shipping information.
  4. Select the available payment method (card or PayPal).
  5. Before finalizing, you must expressly accept these GTC.
  6. After completing the payment, you will receive a confirmation email with your order summary.

VIII. Retention of Title

Ownership of the Products shall pass to the Customer only upon full payment thereof (including VAT and shipping costs, if any).

IX. Delivery Terms and Conditions

  • Standard delivery time: between 1 and 5 business days from order confirmation.
  • Carrier: From the tracking URL you will be able to see the delivery status of your order.
  • Maximum delivery time: 7 calendar days.

If, due to reasons beyond INVICTA RETAIL SPAIN, S.L.'s control, delivery cannot be met within the foreseen timeframe, you will be informed to:

  • Reschedule delivery, or
  • Cancel the order with a full refund.

Delivery will be considered complete when the product is made available to the Customer at the indicated address.

X. Invoicing and Payment

  • Payment methods: Visa/Mastercard bank card and PayPal.
  • Payment is made via a secure gateway with SSL encryption.
  • INVICTA RETAIL SPAIN, S.L. does not store card data.
  • The invoice is issued in electronic format and will be sent by email (a paper copy can be requested).

XI. Product Warranty

Invicta Products include:

  • 3-year legal warranty against manufacturing defects or lack of conformity, according to current regulations (Royal Legislative Decree 1/2007 and EU Directive 2019/771).
  • 1-year battery warranty provided by Invicta as the manufacturer.

To claim the warranty, it will be essential to present the purchase receipt or invoice.

XII. Right of Withdrawal

The Customer has 15 calendar days from the receipt of the order to withdraw from the purchase without needing to provide a reason.

  • The refund will include all amounts paid, except for additional costs for express or non-standard shipping.
  • The Customer must return the Products in perfect condition and in their original packaging.
  • INVICTA RETAIL SPAIN, S.L. will bear the return shipping costs.

XIII. Security

The Invicta Spain website uses SSL security protocols and complies with data protection standards. However, absolute invulnerability on the Internet against third-party attacks cannot be guaranteed.

XIV. Disclaimer

INVICTA RETAIL SPAIN, S.L. will not be responsible for delays, non-compliance, or damages arising from force majeure or causes beyond its reasonable control (strikes, catastrophes, technical incidents, etc.).

The maximum liability of INVICTA RETAIL SPAIN, S.L. to the Client is limited to the amount of the order placed.

XV. Data Protection

INVICTA RETAIL SPAIN, S.L. complies with data protection regulations (LO 3/2018 and GDPR).
Personal data will be processed for order management, invoicing, shipments, and commercial communications, always with the Customer's consent.
